Let’s Talk Notarized Document Form

On August 18, 2011, in Notary Public Services, by RobtheNotary

David asks…

Notary public-notarized form- is it overdue or something?

I had a form notarized (sp?) by a notary public on feb 15, 2008. On the sheet it says her commission expires 5/25/2008. Does that mean that the document is no longer notarized, or just that she is no longer a valid notary after 5/25/2008?

Thank you for your help.

RobtheNotary answers:

Means she must renew by that date or notarize nothing going forward from 5/25/8

if the notary was valid when sealed, the seal stays good.

Helen asks…

How do I get a document notarized?

I have to fill out a form for my school in order to get lowered in-state tuition rates, and it has to be notarized by a Notary Public. What exactly does this mean and how do I do it? Thanks!

RobtheNotary answers:

Look up Notary in the yellow pages. Take all your documents and forms and valid ID with you. Be prepared to pay a fee.

If you are in the States, Notary Publics are a dime a dozen and I am sure you can find one at the bank, an insurance agency, etc.

Here in Canada, in most provinces 99% of Notary Publics are lawyers.

Betty asks…

How do I write a document to be notarized by the bank?

So, to get better credit for an apartment that my boyfriend and I are about to lease, I need to write a letter saying that my mom is paying me 300 dollars a month as a form of income, which needs to get notarized by a bank to be legal.
I don’t know how something like this needs to be written; if I type it out, print it, have my mom sign it, then take it to the bank, or if i need to make it professional or something…

Anyone know what I should do?

RobtheNotary answers:

You only need to have all parties who are signing present and with photo id…(drivers license or passport). The only thing that they notarize is that the person signing is really the person signing…they really don’t care what the form says. Hope that helps!

Daniel asks…

Can a document be notarized over the Internet?

I was told to return a form by email. The form has to be noterized. Is there a way of online notery?

RobtheNotary answers:

NO IT CAN NOT be done On line, the only way a Document can be Notarised is to actually have

1st- A Notarised witness there to verify that You signed it
2nd- a Notarised Stamp from the Notarised person.
3rd- Your ID must be present and maybe along with social security card or some other form of ID

Whoever Gave me a thumbs down you don’t know what you are talking about. You CAN NOT get a legal Paper Notarised without a Notary Public Being Present BOTTOM LINE. Get an Education.
I hate people that THINK they know what they are talking about when they don’t know Shitzzz at all.

No one is Ignoring his statement, But the fact of the matter is When we are talking Legal Document that needs to be Proved by Witness, then the bottom line for the Time being is You MUST see a Notary Public
Look at it this way, Anyone could sign a Document saying you were going to owe them $10,000 dollars and will pay them the money and have it notarised on line. NOW is this a legally Notarised document, It cant be because their was no proof who signed the thing. That’s what I’m getting at nothing less nothing more.
For those Non Belivers, Notary Public – English Dictionary

1. Someone legally empowered to witness signatures and certify a document”s validity and to take depositions

Linda asks…

How can I get a Brazilian document notarized in Florida without going to the Embassy?

My husband and I live in Florida and his mom is selling her apartment in Brazil. In order to do that she needs forms (i think it’s called a power of attorney) signed by all 5 siblings getting their permission to sell the apartment before she can sell it because all the siblings are listed in a will that was made by my husband’s father before he died stating that if the apartment is ever sold his wife get’s 50% and the 5 kids get 10% each. My question is…do we actually have to go all the way to Miami to the Brazilian Embassy just to get a power of attorney notarized to send to his mom in Brazil or is there another way that is easier then having to drive 7 hours to Miami??? Can a regular notary notarize a form for another country?? Really hoping there is an easier way to give his permission to his mom to sell the apartment! Any help is appreciated :)

RobtheNotary answers:

Yes you can get a local notary to verify your signatures but you will still need to send the originals to the nearest Brazilian Consulate to be verified there for a fee of $20.

    Charles asks…

    notarial certificate?

a complete notarial certificate must include all of the following.
    1. the notary’s seal and signature.
    2. the notary’s seal, signature, jurisdiction, and a statement of who appeared on which day, and which act was performed.
    3. the notary’s seal, signature, and the jurisdiction

    RobtheNotary answers:

    #2, of course.

    Jenny asks…

French help! Could u plz translate the NOTARIAL CERTIFICATE into French?

    NOTARIAL CERTIFICATE

This is to certify that the seal of the committee on the transcript above is found authentic. The content of the French translation of the transcript attached hereto is in conformity with the original English version.

    Notary: XX
Natives / experts only, I hate online translations.

    RobtheNotary answers:

Je soussigné XXX (name of notary, if a woman soussignée) certifie que le sceau du comité apposé sur ce relevé de notes est authentique. La traduction française du relevé de notes ci-jointe est conforme à l’original en langue anglaise.

Are we talking about school transcripts? Because this is what relevé de notes is, otherwise the correct word is “transcription”
    Notarial certificate: attestation notariée
Notary: notaire (whether male or female)

    Sharon asks…

Whether a copy (not original) of notarial certificate of birth is good for filing USCIS Form I-130?

It said some copies of documents were okay, but it didn’t mention anything about a notarial certificate of birth.

    RobtheNotary answers:

No. Original forms only. No copies.

    Steven asks…

How does a California Notary Public certify copies of a power of attorney?

I just acknowledged the signature on the power of attorney. I have the original in my possession and I need to certify copies for my client. I have the proper notarial language for the certificate and I understand that I need to sign and stamp it. Do I then make a journal entry with my information and signature?
Perhaps I need to clarify – I am a notary and I know I am authorized to certify copies of a power of attorney. The CA secretary of state handbook does not give information on proper procedures for journal entry.

    RobtheNotary answers:

You can notarize a signature. Beyond that you have no legal right to do anything else. All you are allowed to do is certify by your notary seal and signature that you witnessed the person signing the document and that you personally know the person is who he claims to be.

Below is a link to courses related to passing the Missouri notary exam. Note, in particular, that two of the courses are marked as Missouri State – Required courses. One is live and the other is on-line. If either of these required courses for the Missouri Notary exam do not answer all of your questions, then you ought to get your money back, I think. May it go well with you.

    Hope this helps.

Typical fee for Notary Public services in Georgia?

I just got certified as a notary public for my job but have no idea what to charge (I got certified so that I can notarize in-house documents, but might as well make some money off it outside of my job). I’m not even sure what to do with it… Any tips/advice?

      RobtheNotary answers:

First don’t listen to people that aren’t experienced notaries and answer these questions, there totally clueless!

Second every state has different mandated notary prices that one can charge per notary document. Here in Texas the maximum is $5 per notary stamp and $1 per signature, so $6 usually per document. In California, who have by far the higest paid notaries it’s $10.00 per stamp.

Then unlike a bank, UPS or Pakmail store that’s only open usually M-F in normal business hours. A mobile notary can charge whatever they want for print out fees, travel charges and wait times. That is where the real money is anyways.

Our minimum for any mobile Austin notary service is $26, if less then 10 miles traveled one-way. We’re the cheapest minimum trip charge that I know of in Texas. I’ve seen anywhere from $25-$50 minimum trip charges other notaries charge people nationwide.

You just have to research your market place, just google “Georgia notary” or “your city notary” in Google. Then just see what other notaries in your area charge to better set your prices.Your green and have no experience, so I would go on the very low side to then gain some experience and clients.

Check out www.nationalnotary.org there the biggest notary governing body in the country, and they can help you with what you can charge in GA.

      Hope that helps,

I think $10 is the cheapest you can EVER find… Sorry!

The primary purpose of the Notary Public is to prevent fraud by forgery. Notaries are most
often used whenever real property is purchased or transferred to another party. Part of
either transaction will include the notarization of certain documents by a notary public.
        What Is A Notary Public?
A notary public is a reputable witness, commissioned by California’s Secretary of State, who may legally certify by
written acknowledgment on a document that he or she knows you to be the person who has executed the document.
Note: Any person requesting notarization of a will should be referred to an attorney.

Why Is A Notary Public Necessary?
The law required notary certifications under many situations. Most documents in real property transactions, such as a
grant deed or trust deed, must be notarized before they can be recorded by the county recorder. When you have an
important document notarized it affords you the fullest protection against possible forgery.

Who Is Entitled To Be A Notary Public?
In California, a notary public must be a citizen of the United States, a legal resident of the state in which he or she is
commissioned, not less than 18 years of age, and must satisfy the Secretary of State that he or she is of good moral
character. A notary public must also satisfactorily pass a qualification examination and provide a performance bond
under which any official misconduct or neglect of the notary public makes the notary, together with the surety of the
bond, liable to the persons injured thereby for damages sustained.

How And Where Does A Notary Public Perform The Notarial Service?
Notarization takes place only in the state where the notary public has been commissioned. The notary certifies to the
identity of the person appearing and signing the document on the date and in the county specified on the notary
certification. The notary’s certification testifies that the signatures on the document is genuine. The notary public
maintains a complete record book to preserve evidence of the acknowledgement. For identification purposes, the
notary public required that the signatures of the parties executing the document also be signed in the record book.
Your notary public provides an important professional servic e and is entitles to charge a fee for such services. The
Secretary of State establishes the maximum fees a notary public may charge.

        Notary Public Guidelines

        • Should not notarize any instrument or document if the party signing the document is not present or doesn’t
sign the document in his or her presence.
        • Should not draw legal agreements or attempt to give legal advice of any nature (unless the notary is also an
        attorney)
        • Should not notarize any signature unless the party is personally known to the notary or satisfactory
identification is provided to the notary.
        • Should not authorize anyone else to notarize for him or her.
        • Should not notarize out of state in which the commission has been granted.
        • Should require proper identification such as a drivers license, passport or California/military I.D.
        • May require a thumbprint (right hand).
